{"id":1770,"date":"2020-05-29T10:33:51","date_gmt":"2020-05-29T01:33:51","guid":{"rendered":"https:\/\/www.kuroda-law.gr.jp\/tw\/?p=1770"},"modified":"2021-07-30T18:06:42","modified_gmt":"2021-07-30T09:06:42","slug":"%e7%ac%ac%ef%bc%99%e5%9b%9e%e3%80%80%e9%97%9c%e6%96%bc%e8%91%a3%e4%ba%8b%e6%9c%83%ef%bc%88%e5%8f%96%e7%b7%a0%e5%bd%b9%e6%9c%83%ef%bc%89%e6%9c%83%e8%ad%b0%e4%b9%8b%e6%97%a5%e5%8f%b0%e5%b7%ae%e7%95%b0","status":"publish","type":"post","link":"https:\/\/www.kuroda-law.gr.jp\/tw\/columns\/taiwan-jptwlaw-comparison\/1770\/","title":{"rendered":"\u7b2c9\u7de8\u3000\u95dc\u65bc\u8463\u4e8b\u6703\uff08\u53d6\u7de0\u5f79\u6703\uff09\u6703\u8b70\u4e4b\u65e5\u53f0\u5dee\u7570"},"content":{"rendered":"\n<p>\u63a5\u4e0a\u6b21\u5167\u5bb9\uff0c\u5c31\u53f0\u7063\u516c\u53f8\u6cd5\uff08\u4ee5\u4e0b\u7a31\u300c\u53f0\u7063\u6cd5\u300d\uff09\u8207\u65e5\u672c\u516c\u53f8\u6cd5\uff08\u4ee5\u4e0b\u7a31\u300c\u65e5\u672c\u6cd5\u300d\uff09\u4e2d\u8463\u4e8b\u6703\uff08\u53d6\u7de0\u5f79\u6703\uff09\u4e4b\u5dee\u7570\u9032\u884c\u4ecb\u7d39\u3002\u672c\u6b21\u8b93\u6211\u5011\u4f86\u770b\u4e00\u4e0b\u8463\u4e8b\u6703\uff08\u53d6\u7de0\u5f79\u6703\uff09\u6703\u8b70\u4e4b\u5dee\u7570\u3002<\/p>\n<h3><strong>1<\/strong><strong>\u3000\u51fa\u5e2d\u9580\u6abb\u53ca\u6c7a\u8b70\u9580\u6abb<\/strong><\/h3>\n<p>\u65e5\u672c\u6cd5\u4e2d\uff0c\u898f\u5b9a\u53d6\u7de0\u5f79\u6703\uff08\u76f8\u7576\u65bc\u53f0\u7063\u6cd5\u4e2d\u4e4b\u8463\u4e8b\u6703\uff09\u4e4b\u6c7a\u8b70\uff0c\u61c9\u6709\u904e\u534a\u6578<strong>\u5f97\u52a0\u5165\u8868\u6c7a\u4e4b\u53d6\u7de0\u5f79<\/strong>\uff08\u76f8\u7576\u65bc\u53f0\u7063\u6cd5\u4e2d\u4e4b\u8463\u4e8b\uff09\u51fa\u5e2d\uff08\u4ee5\u4e0b\u7a31\u70ba\u51fa\u5e2d\u9580\u6abb\uff09\uff0c\u51fa\u5e2d\u53d6\u7de0\u5f79\u904e\u534a\u6578\u4e4b\u540c\u610f\u884c\u4e4b\uff08\u4ee5\u4e0b\u7a31\u70ba\u6c7a\u8b70\u9580\u6abb\uff09\uff08\u65e5\u672c\u6cd5\u7b2c369\u689d\u7b2c1\u9805\uff09\u3002<\/p>\n<p>\u53c8\uff0c<strong>\u4ea6\u5f97<\/strong>\u4ee5\u7ae0\u7a0b<strong>\u63d0\u9ad8<\/strong>\u51fa\u5e2d\u9580\u6abb\u53ca\u6c7a\u8b70\u9580\u6abb\uff08\u540c\u9805\u62ec\u5f27\u5167\u5167\u5bb9\uff09\u3002<\/p>\n<p>\u53f0\u7063\u6cd5\u4e2d\uff0c\u898f\u5b9a\u8463\u4e8b\u6703\u4e4b\u6c7a\u8b70\uff0c\u61c9\u6709\u904e\u534a\u6578<strong>\u5f97\u51fa\u5e2d\u6703\u8b70\u4e4b\u8463\u4e8b<\/strong>\u51fa\u5e2d\uff0c\u51fa\u5e2d\u8463\u4e8b\u904e\u534a\u6578\u4e4b\u540c\u610f\u884c\u4e4b\uff08\u53f0\u7063\u6cd5\u7b2c206\u689d\u7b2c1\u9805\uff09\u3002<\/p>\n<p>\u65e5\u672c\u6cd5\u4e2d\u5f97\u52a0\u5165\u300c<strong>\u8868\u6c7a<\/strong>\u300d\u4e4b\u53d6\u7de0\u5f79\u69cb\u6210\u51fa\u5e2d\u9580\u6abb\u57fa\u6e96\uff0c\u53f0\u7063\u6cd5\u4e2d\u5f97\u300c<strong>\u51fa\u5e2d<\/strong>\u300d\u6703\u8b70\u4e4b\u8463\u4e8b\u69cb\u6210\u51fa\u5e2d\u9580\u6abb\u57fa\u6e96\uff0c\u4f46\u662f\u51fa\u73fe\u6b64\u5dee\u7570\u4fc2\u65bc\u5b58\u5728<strong>\u5c0d\u6c7a\u8b70\u6709\u81ea\u8eab\u5229\u5bb3\u95dc\u4fc2\u4e4b\u8463\u4e8b\uff08\u53d6\u7de0\u5f79\uff09<\/strong>\u4e4b\u60c5\u5f62\u3002\u65e5\u672c\u6cd5\u4e2d\uff0c\u6709\u81ea\u8eab\u5229\u5bb3\u95dc\u4fc2\u4e4b\u53d6\u7de0\u5f79\u4e0d\u5f97\u52a0\u5165\u8868\u6c7a\uff08\u65e5\u672c\u6cd5\u7b2c369\u689d\u7b2c2\u9805\uff09\uff0c\u6545<strong>\u4e0d\u5305\u542b\u65bc\u51fa\u5e2d\u9580\u6abb\u5167<\/strong>\u3002\u53e6\u4e00\u65b9\u9762\uff0c\u53f0\u7063\u6cd5\u4e2d\uff0c\u6709\u81ea\u8eab\u5229\u5bb3\u95dc\u4fc2\u4e4b\u8463\u4e8b\u4e0d\u5f97\u52a0\u5165\u8868\u6c7a\uff08\u53f0\u7063\u6cd5\u7b2c206\u689d\u7b2c4\u9805\u3001\u7b2c178\u689d\uff09\uff0c\u4f46\u4e0d\u9650\u5236\u51fa\u5e2d\u6703\u8b70\uff082002\u5e745\u670816\u65e5\u7d93\u5546\u5b57\u7b2c09102088350\u865f\u901a\u77e5\uff09\uff0c\u6545<strong>\u5305\u542b\u65bc\u51fa\u5e2d\u9580\u6abb\u5167<\/strong>\u3002<\/p>\n<p>\u53c8\uff0c\u53f0\u7063\u6cd5\u4e2d\uff0c\u8207\u65e5\u672c\u6cd5\u4e0d\u540c\uff0c<strong>\u6c92\u6709\u5f97<\/strong>\u4ee5\u7ae0\u7a0b<strong>\u63d0\u9ad8<\/strong>\u51fa\u5e2d\u9580\u6abb\u53ca\u6c7a\u8b70\u9580\u6abb\u9019\u6a23\u7684<strong>\u660e\u6587\u898f\u5b9a\u3002<\/strong>\u5be6\u52d9\u4e2d\uff0c\u5f9e\u524d\u898f\u5b9a\u5f97\u4ee5\u7ae0\u7a0b\u63d0\u9ad8\u9580\u6abb\uff082011\u5e742\u670823\u65e5\u7d93\u5546\u5b57\u7b2c10002403260\u865f\u901a\u77e5\uff09\u3002\u4f46\u662f\uff0c\u73fe\u5728\u8a72\u901a\u77e5\u5df2\u5ee2\u6b62\uff0c\u898f\u5b9a\u9664\u6709\u5f97\u63d0\u9ad8\u9580\u6abb\u4e4b\u660e\u6587\u898f\u5b9a\u5916\uff0c<strong>\u4e0d\u5f97\u4ee5\u7ae0\u7a0b\u63d0\u9ad8\u9580\u6abb<\/strong>\uff082019\u5e745\u67088\u65e5\u7d93\u5546\u5b57\u7b2c10802410490\u865f\u901a\u77e5\uff09\u3002<\/p>\n<h3><strong>2<\/strong><strong>\u3000\u8996\u8a0a\u6703\u8b70\u3001\u96fb\u8a71\u6703\u8b70<\/strong><\/h3>\n<p>\u65e5\u672c\u6cd5\u4e2d\u898f\u5b9a\u5404\u53d6\u7de0\u5f79\u672a\u5fc5\u9700\u8981\u89aa\u81ea\u51fa\u5e2d\u53d6\u7de0\u5f79\u6703\u53ec\u958b\u5834\u6240\uff0c\u4ea6\u5f97\u4ee5\u8996\u8a0a\u6703\u8b70\u6216\u96fb\u8a71\u6703\u8b70\u4e4b\u65b9\u5f0f\u51fa\u5e2d\uff08\u53c3\u898b\u65e5\u672c\u6cd5\u65bd\u884c\u898f\u5247\u7b2c101\u689d\u7b2c3\u9805\u7b2c1\u865f\u3001\u798f\u5ca1\u5730\u65b9\u6cd5\u96622011\u5e748\u67089\u65e5\u5224\u6c7a\uff09\u3002<\/p>\n<p>\u4f46\u662f\uff0c\u6709\u5224\u4f8b\u8a8d\u70ba\u95dc\u65bc\u96fb\u8a71\u6703\u8b70\uff0c\u9700\u8981\u5305\u62ec\u9060\u5730\u53d6\u7de0\u5f79\u5728\u5167\u4e4b\u5404\u53d6\u7de0\u5f79\u8207\u6703\u65bc\u4e00\u5802\u4e00\u6a23\uff0c\u8655\u65bc\u5f97\u81ea\u7531\u5354\u5546\u4e43\u81f3\u4ea4\u63db\u610f\u898b\u4e4b\u72c0\u614b\uff0c\u7531\u5728\u53ec\u958b\u5834\u6240\u4e4b\u53d6\u7de0\u5f79\u908a\u81f4\u96fb\u4e0d\u5728\u5834\u4e4b\u53d6\u7de0\u5f79\u807d\u53d6\u610f\u898b\u908a\u63a8\u9032\u8b70\u4e8b\u5c1a\u986f\u4e0d\u8db3\uff08\u53c3\u898b\u4e0a\u8ff0\u798f\u5ca1\u5730\u65b9\u6cd5\u96622011\u5e748\u67089\u65e5\u5224\u6c7a\uff09\u3002<\/p>\n<p>\u53f0\u7063\u6cd5\u4e2d\u4ea6\u898f\u5b9a\uff0c\u8463\u4e8b\u6703\u4ee5\u8996\u8a0a\u624b\u6bb5\u53ec\u958b\u6642\uff0c\u8463\u4e8b\u4ee5\u8a72\u624b\u6bb5\u53c3\u8207\u6703\u8b70\u8005\uff0c\u8996\u70ba\u89aa\u81ea\u51fa\u5e2d\uff08\u53f0\u7063\u6cd5\u7b2c205\u689d\u7b2c2\u9805\uff09\u3002<\/p>\n<p>\u4f46\u662f\uff0c\u8207\u8996\u8a0a\u6703\u8b70\u4e0d\u540c\uff0c\u7531\u65bc\u96fb\u8a71\u6703\u8b70\u7121\u6cd5\u5c0d\u8463\u4e8b\u4e4b\u81ea\u9858\u9032\u884c\u78ba\u8a8d\uff0c\u56e0\u6b64\u88ab\u89e3\u91cb\u70ba\u51fa\u5e2d\u4ee5\u6b64\u7a2e\u65b9\u5f0f\u53ec\u958b\u4e4b\u8463\u4e8b\u6703\u4e4b\u8463\u4e8b\u4e0d\u5f97\u8996\u70ba\u51fa\u5e2d\uff08\u53f0\u4e2d\u5730\u65b9\u6cd5\u96622010\u5e74\u5ea6\u8a34\u5b57\u7b2c694\u865f\u6c11\u4e8b\u5224\u6c7a\u4e4b\u898b\u89e3\uff09\u3002<\/p>\n<h3><strong>3<\/strong><strong>\u3000\u4ee3\u7406\u51fa\u5e2d<\/strong><\/h3>\n<p>\u65e5\u672c\u6cd5\u4e2d\uff0c\u95dc\u65bc\u80a1\u6771\u5927\u6703\u6c7a\u8b70\uff0c\u6709\u4ee3\u7406\u884c\u4f7f\u4e4b\u898f\u5b9a\uff08\u65e5\u672c\u6cd5\u7b2c310\u689d\uff09\uff0c\u4f46\u662f\u95dc\u65bc\u53d6\u7de0\u5f79\u6703\u6c7a\u8b70<strong>\u6c92\u6709\u4ee3\u7406\u884c\u4f7f\u4e4b\u898f\u5b9a<\/strong>\u3002\u7531\u65bc\u53d6\u7de0\u5f79\u6703\u4e0a\u6bcf\u4f4d\u53d6\u7de0\u5f79\u64c1\u67091\u7968\u8868\u6c7a\u6b0a\uff0c\u56e0\u6b64\u4e00\u822c\u8a8d\u70ba\u4e26\u672a\u64ec\u5b9a\u59d4\u8a17\u5176\u4ed6\u53d6\u7de0\u5f79\u4ee3\u7406\u884c\u4f7f\u3002<\/p>\n<p>\u4f46\u662f\uff0c\u53f0\u7063\u6cd5\u4e2d\uff0c<strong>\u5f97\u4f7f<\/strong>\u5176\u4ed6\u8463\u4e8b<strong>\u4ee3\u7406\u51fa\u5e2d<\/strong>\u3002\u8463\u4e8b\u59d4\u8a17\u5176\u4ed6\u8463\u4e8b\u4ee3\u7406\u51fa\u5e2d\u6642\uff0c\u61c9\u65bc\u6bcf\u6b21\u88fd\u4f5c\u59d4\u8a17\u66f8\uff0c\u4e26\u53c3\u7167\u8b70\u984c\u65bc\u59d4\u8a17\u66f8\u4e2d\u8a3b\u660e\u6388\u6b0a\u7bc4\u570d\uff08\u53f0\u7063\u6cd5\u7b2c205\u689d\u7b2c3\u9805\uff09\u3002\u53c8\uff0c\u4ee3\u7406\u4eba\u4ee5\u53d71\u540d\u8463\u4e8b\u4e4b\u59d4\u8a17\u70ba\u9650\uff08\u540c\u689d\u7b2c4\u9805\uff09\u3002\u3000<\/p>\n<p>\u53e6\u5916\uff0c\u4ee5\u524d\uff0c\u8463\u4e8b\u5c45\u4f4f\u6d77\u5916\u8005\uff0c\u4ea6\u6709\u66f8\u9762\u59d4\u8a17\u5c45\u4f4f\u53f0\u7063\u4e4b\u5176\u4ed6\u80a1\u6771\u4ee3\u7406\u51fa\u5e2d\u4e4b\u65b9\u6cd5\uff08\u7a31\u5176\u70ba\u7d93\u5e38\u4ee3\u7406\uff09\u3002<\/p>\n<p>\u4f46\u662f\uff0c\u5982\u4e0a\u6240\u8ff0\uff0c\u7531\u65bc\u73fe\u884c\u6cd5\u627f\u8a8d\u4ee5\u8996\u8a0a\u6703\u8b70\u51fa\u5e2d\u8463\u4e8b\u6703\uff0c\u56e0\u6b64\u65bc2018\u5e74\u5ee2\u9664\u4e86\u7d93\u5e38\u4ee3\u7406\u4e4b\u898f\u5b9a\u3002<\/p>\n<h3><strong>4<\/strong><strong>\u3000\u8b70\u4e8b\u9332\u4e4b\u4f5c\u6210\u7fa9\u52d9<\/strong><\/h3>\n<p>\u65e5\u672c\u6cd5\u4e2d\uff0c\u53d6\u7de0\u5f79\u6703\u8b70\u4e8b\u9332\u4ee5\u66f8\u9762\u4f5c\u6210\u6642\uff0c\u61c9\u7531<strong>\u51fa\u5e2d\u53d6\u7de0\u5f79\u53ca\u76e3\u67e5\u5f79\u7c3d\u540d<\/strong>\uff08\u7531\u672c\u4eba\u89aa\u7b46\u66f8\u5beb\u59d3\u540d\uff09\u6216<strong>\u7c3d\u5b57<\/strong>\uff08\u4ee5\u6253\u5b57\u7b49\u975e\u672c\u4eba\u89aa\u7b46\u66f8\u5beb\u4e4b\u65b9\u6cd5\u8a18\u8f09\u59d3\u540d\uff09<strong>\u84cb\u7ae0<\/strong>\uff08\u65e5\u672c\u6cd5\u7b2c369\u689d\u7b2c3\u9805\uff09\u3002\u53c8\uff0c\u4ea6\u5f97\u4ee5\u96fb\u5b50\u65b9\u5f0f\u70ba\u4e4b\uff08\u65e5\u672c\u6cd5\u7b2c369\u689d\u7b2c4\u9805\uff09\u3002<\/p>\n<p>\u53f0\u7063\u6cd5\u4e2d\uff0c\u61c9\u4f5c\u6210\u8463\u4e8b\u6703\u8b70\u4e8b\u9332\uff0c\u7531<strong>\u4e3b\u5e2d\u7c3d\u540d\u6216\u84cb\u7ae0<\/strong>\uff08\u53f0\u7063\u6cd5\u7b2c207\u689d\u7b2c1\u9805\u3001\u540c\u689d\u7b2c2\u9805\u3001\u7b2c183\u689d\u7b2c1\u9805\uff09\u3002<\/p>\n<p>\u53f0\u7063\u6cd5\u4e2d\uff0c\u898f\u5b9a\u84cb\u7ae0\u8207\u7c3d\u540d\u751f\u540c\u7b49\u4e4b\u6548\u529b\uff08\u53f0\u7063\u6c11\u6cd5\u7b2c3\u689d\u7b2c2\u9805\uff09\uff0c\u8207\u65e5\u672c\u6cd5\u4e0d\u540c\uff0c\u672a\u8981\u6c42\u84cb\u7ae0\u6642\u4e4b\u300c\u7c3d\u5b57\u300d\u3002<\/p>\n<p>\u53c8\uff0c\u53f0\u7063\u6cd5\u4e2d\uff0c\u8207\u65e5\u672c\u6cd5\u4e0d\u540c\uff0c\u4e26\u672a\u8981\u6c42\u7531\u300c\u51fa\u5e2d\u8005\u300d\u7c3d\u540d\u6216\u84cb\u7ae0\uff0c
